Illegal Immigrant Charged in Johnston County Deaths

    Is this an Illegal Immigrant problem or a DWI problem? Or both? And what should we do to prevent these tradegies?

    Smithfield — The driver of a car that slammed into a tractor-trailer Sunday night, killing two people, was charged Tuesday morning with involuntary manslaughter, authorities said.

    Luciano Tellez, 31, of Angier, who is also known as Tellez Diaz, was charged Monday night with two counts of misdemeanor death by vehicle, felony hit-and-run, running a stop sign and driving with a suspended license.

    Federal authorities have determined that Diaz was in the U.S. illegally and have placed a detainer on him in case he makes his $2 million bond and is released from the Johnston County Detention Center. Authorities said they would let the legal system run its course before determining whether to deport him.

    The state Highway Patrol is still trying to sort out the details involving the fatal wreck, which occurred at the intersection of N.C. Highway 210 and Plainview Church Road near Angier.

    Authorities said Tellez ran a stop sign at the intersection and rammed into a tractor-trailer. The rig veered off the road, overturned and caught fire, killing the driver and a passenger, authorities said.

    Tellez fled the scene on foot. Two passengers in the car remained at the scene and told authorities what happened.

    Authorities identified the two victims of the wreck as Jerry "Dwayne" Braswell, 35, of 3833 Manor Drive in Clayton, and his 9-year-old son, Jerry Braswell Jr.

    The boy was a third-grader at Cleveland Elementary School, and school officials had counselors on campus Tuesday to talk with other students.

    "He always had a smile on his face and a funny story to tell," Principal Linda Edmundson said. "Jerry will truly be missed."

    A family friend said Braswell and his son were heading home Sunday evening when the wreck occurred. The father often took his son and his 12-year-old daughter along when he dropped off equipment and picked up his paycheck on Sundays, the friend said.

    Braswell's daughter was home sick Sunday night, the friend said.

    Authorities also found that Tellez was wanted for violating the terms of his probation. He was convicted of drunken driving in 2005 and has a suspended license, authorities said. Authorities said they believe alcohol played a role in Sunday's wreck.

    Raleigh police weren't required to inform immigration officials of Tellez' prior arrest because he was charged only with a misdemeanor and had a valid driver's license, said Jim Sughrue, spokesman for the Raleigh Police Department.

    Braswell is survived by his wife and a 12-year-old daughter. A visitation will be held from noon until 2 p.m. Thursday at Raleigh First Church of the Nazarene on U.S. Highway 70 in Garner, followed immediately by funeral services.

    I say that because he is an illegal alien, he probably doen't understand our laws so we should just let him free. Once he is free we should make him a citizen and worship the ground he walks on.

    I actually heard on the news last night that there could be a proposed law that would immediately deport illegal immigrants who were caught for DUI charges. Wooo-hooo... don't we already deport the illegal ones that get caught??

    Why deport?

    Does it do any good to deport? Seems like these illegals from south of the border just re-enter after we deport them.
    In my opinion the only way to control illegals is to not allow them to work. The only way to stop that is to fine the businesses that employ them. In my opinion this will never happen.
    For example. Who was this illegal working for? If he has no job he does not stay here. Pure and simple! Are we doing business with his employer? I bet we never hear about this.

    This makes absolutely no sense to me...

    What the heck?! This guy is here ILLEGALLY, yet he has had a license, a criminal record, and is on probation? If they had deported his sorry butt the first time he was caught here doing something wrong that innocent man and his little boy would still be alive!!!!! What a bunch of pansies we have running this country!!!!!!!!!! :evil:

    I would love to see some kind of organized indignation from our community towards our law makers and court system. If anyone knows of a powerful voice in government or the media who has an interest in the case, please post it here, or if there is to be any reaction from family or friends, please post it on this forum.

    I left a message with Congressman Tom Tancredo's (R-CO) office this morning concerning this issue. Mr. Tancredo was the Chairman of the Congressional Immigration Reform Caucus. I didn't realize until after the call was made that Congressman Tancredo has stepped down as chairman of the group and now Congressman Brian Bilbray (R-CA) has taken over the position. I mailed copies of the stories from 1270wmpm, the N&O & WRAL to Congressman Tancredo's office. Now that I know about the new chairman of the Immigration Reform Caucus, I plan to contact Congressman Bilbray's office also. This morning copies of the story were sent to US Representative Sue Myrick (R-NC) and www.nclisten.com .

    U.S. Rep. Sue Myrick today plans to reintroduce a bill that would deport any illegal immigrant convicted of driving while impaired.

    The "Scott Gardner Act," named for a Mount Holly teacher killed in a 2005 wreck, also would make it easier for law enforcement agencies to share information about a person's immigration status.

    The act was included in an immigration package approved in 2005 by the U.S. House, but never considered by the Senate.

    At the Monday news conference, Myrick said there seems to be a commitment to get immigration laws passed through both chambers this year.

    Myrick invited family members of people killed in DWI accidents. Jennifer Raper of China Grove wondered if the Gardner Act could have saved her cousin, Leeanna Newman who was killed in a Feb. 6 wreck with a man who is in the country illegally and was allegedly drinking. Newman was eight months pregnant.

    "I'll never know the answer to that question," Raper said.

    Also at the news conference, Mecklenburg Sheriff Jim Pendergraph said the county has identified 1,520 illegal immigrants since May 1 who have committed crimes and will be deported. Of those, 318 were arrested for DWI.

    During a question and answer session, Maudia Melendez stood and said that drinking and driving is a problem for the whole community, not just Hispanics. Melendez is head of the Jesus Ministry, a local Latino advocacy group.

    Myrick said the Gardner Act only deals with illegal immigrants charged with drunk driving because that falls within the federal government's responsibility. She encouraged people to talk with state leaders about strengthening other DWI laws.

    Emily Moose, Scott Gardner's mother, said she believes the act will save lives.

    "Justice can only be served when every single citizen, whether they are affected directly by these crimes or not, become as indignant about it as I am," said Moose.

    Thank you for your activism.

    Now, how about a law that deports them for breaking ANY LAW... because technically, any offense they commit automatically comes with IN THE COUNTRY ILLEGALLY on top of whatever they did. Softball rules... two strikes and you're out. :)

    PS: Has anyone noticed that the news organizations have stopped telling us about wanted persons with Mexican names until after they're picked up?

    Read in a forum somewhere of what a person has come up with for an idea to do with illegals. First you round them all up and fly them over to Iraq. Drop them off and give them a gun and ammo, and for each one you drop off you bring home a US soldier. After a 2 years of service grant them citizenship and tax the crap out of them.

    Course this person also recommended micro chipping before dropping them off like you would an dog or cat, so that you can keep track of who is who when it's time to make them a citizen.
