in general , i'd say no.

but there must have been some reason they thought that they couldn't convict him on any more serious charges. and now that he's been convicted for this incident, wouldn't further charges related to it be double jeopardy? makes me wonder if that's only half the sentence. like, they won't press charges if it ever dies from this incident, but future incidents will be seperate? i would doubt that they would give the guy carte blanche to go kill the kid with guaranteed immunity...

no, none of that makes any sense.

Say this child has permanent brain damage due to the injuries he suffered at his "father's" hands, and those injuries claim his life in the future, is 6-8 years enough for what should then be considered murder? Even if he lives but has life-long injuries due to what his sperm donor did to him, wouldn't he be serving a much greater sentence than dear ol' dad? I question whether 8 years is long enough for what this man did to this baby.

Just sad that an innocent little baby had to suffer so much and at the hands of the one who should be protecting him the most. :-(

    Clif, don't even start... ;)

It says he entered an Alford plea. That means he did not admit guilt, but agreed not to fight the charges. I'm guessing the DA does not have enough evidence to be sure of a conviction, but the guy realizes he could be convicted and receive a lot more time. The agreement about not pressing further charges if the child dies would mean only if he dies as a result of those injuries, it certainly does not give him the right to do anything else to the child. We really don't know what happened - it could have been an accident, or negligence, or ??

Anyway, let's hope and pray that the baby will be OK.

$1M bail set for mom accused of killing baby

    http://www.twincities.com/localnews/ci_5662691?nclick_check=1

A Washington County district judge set bail at $1 million Friday for a teenage mother accused of delivering her baby, stabbing her 135 times and dumping the child's body in a garbage can.

Judge Greg Galler denied an attorney's request to release 17-year-old Nicole Marie Beecroft, of Oakdale, to her family and said she could receive psychological help while she's held in the county's juvenile detention center.

Despite defense attorney Earl Gray's concern that Beecroft could not cope with jail, the judge assured him, "She'll survive."

A handcuffed Beecroft entered the hearing wearing gray sweat clothes and was somber and quiet during the court hearing. Several of her family members and supporters broke into sobs during the proceedings. At the end, a few called out "We love you!" - causing Beecroft to break down in tears. One man tried to hug her before being restrained by a court security officer.

The scene outside the courthouse was loud and angry, as family and supporters yelled at reporters and refused to comment. Several television cameramen and news photographers followed the family into the parking lot after bail was set.

Several supporters clustered around Kari Beecroft, the defendant's mother, to separate her from cameras as she left the building. One shielded her face with a jacket, and others tried to cover their faces.

Beecroft was booked as an adult on first-degree murder charges Friday. She will remain in the juvenile center of the Washington County Jail.

She could spend the rest of her life in prison if convicted.

Prosecutors said Beecroft, a Tartan High School senior who goes by "Nikki," had the baby at 3 a.m. Monday in the laundry room of her Oakdale home, then stabbed the infant to death. She allegedly put the baby girl's body into a garbage can outside the house.

According to a criminal complaint filed Thursday, Beecroft originally told detectives she gave birth to a stillborn daughter on a towel.

When confronted with an autopsy report that concluded the baby had been born alive but had been stabbed 135 times, Beecroft told investigators she did it in a fit of panic, the complaint stated. She also told officers that after giving birth, she had seen her baby daughter's finger move.

Gray, who said he was representing Beecroft at the initial hearing, asked Galler to release the teen to her mother. He said she had no criminal record, posed no threat to others and held two jobs while attending school. He asked that she be confined at home with an electronic monitoring device.

"It will do no good to see her in jail," Gray said. The judge denied his request but said bail could be reviewed at a later hearing.

Beecroft is scheduled to appear in court next on April 27.

Oh now that one makes me want to throw up!!! Oh my, that poor baby. There are so many families that would adopt a new born in an instant... I am in shock. She at least needs to be sterilized. Man I want to rip her uterus out myself. (I've assisted with enough spay surgeries, I think I can figure it out!!!!)

    Ok... shutting up now.
