Abuse of Power

    This guy needs to bumped off the bench. I cannot believe someone who is so unjust is a judge. This case should have been thrown out or sent to small claims.

    I can't believe this got a date on a court calendar...

    I'm so disgusted I'm speechless for once..

    From what I heard on NPR this afternoon, the presiding Judge is disgusted with the case. Depending on how the judge rules the Chung family may be in a position for a little revenge; they said the Chung family probably won't because they are not litigious, just hardworking.

    First off, shame on you for listening to NPR :twisted: j/k

    I don't know how much the Chungs have paid in legal fees so far, but I would think THAT amount would be fair to be awarded to the Chungs, but I must say it's stand up for them to turn the other cheek and put it behind them.

    I think the guy bringing the lawsuit is a nut case.

    I hope the judge (by which I mean the real judge who is hearing the case, not the ALJ who is bringing it) makes the plaintiff pay the Chung's legal fees.

    In Europe, the normal practice is that the losing party has to pay the winning party's costs. The American system is that each party pays their own costs, except in unusual circumstances. Instituting the European system might be one way to reduce the number of idiot lawsuits like this.

    Like it or not, it is NOT an abuse of power. He brought the case as a citizen and has little to do with his position.

    Although I will concede that his position makes him well suited for this type of thing and gives him a good deal of experience in the legal system.

    I think he has demonstrated that he is not competent to hold his current position in the judicial system.

    Aaack! I agree with mafia man! It is an abuse of the system, and he should be subject to sanctions. I think several different organizations are working to get him removed from his position. Which is easier to do with an ALJ than an Article III judge.

    Off topic, I still get a kick out of Polentardmafia's name.

    I know it is supposed to be Polenta-Rd-Mafia, but the first time I read it and always look at the same since is Polen--My Friend-mafia.

    It is wrong, I know.

    On topic, I agree that this dude needs to be pwned by the very same legal system he is taking advantage of. I hope his shirt stains never come clean!

    Just another re-My Friend looking for a free ride by sueing. We all pay when one sues. To recoup costs big business just ups the price to everyone. When are we going to wake up and stop sueing each other? The only real winners are the lawyers.

    In this case, it is a small business that is being sued. They do not have the luxury of simply raising their prices to recoup their costs. If they raise their prices and all the surrounding dry cleaners do not, what is going to happen to their business? The idiot plaintiff is representing himself, so no lawyer is making money on his side. The poor business owners in this case are stuck with their own legal fees, and no way to recoup the cost. Unless the court sanctions the idiot for filing a frivolous lawsuit, which I sincerely hope it will.

    They actually found his pants right? Then offered him $3,000.00 on top of that. This judge is also an appointed judge who is up for a new 10 year term. Think he will get it?

    Lets not forget they may have liabillity insurance to cover this type of action. If you are a small business you already know that workmans comp and liabillity are the major nut in the overhead. The great thing about the insurance is you pay to be covered and when you have a claim you pay more after. The sad part on this one is their damned if they win and damned if they loose.
