My son was injured at his job. Number one : they made him wait 8 hours for medical help, then they docked his pay for the time he missed. The biggest thing is they wrote the time lost as illegal absences. He was taken out of work by a doctor and he was on crutches, he went back when he was told he could by the doctor. Since they listed he days out as illegal absences, he was told if he loses one more day he will be disiplined. Is this common practice? He works for a big company at the airport. I've never worked anywhere like that. If he was injured on the job, then that should fall under worker's comp and he should have received pay during his absence and shouldn't have had "illegal" abscesses..that doesn't make any sense. Then again, we are an "at will" state, which means any employer can fire you at any time for any reason.
yep i was about to say the same thing, i use to work for a hospital in raleigh and they knew i was sick, came in anyway and by the end of the day i was in the er and was out sick for a week and i still got wrote up! so yea they can pretty much do that of they want to!
Just curious and for my own reference... Did he get hurt from his own stupidity? (for lack of better word - not at all saying he's stupid) Meaning was he horse-playing? not paying attention? other? OR Was it a malfunction equipment? freak accident? improper railing around fall areas? ect... I hope he's alright... nothing permanently damage?
He was off loading something and the guy behind him released a large piece of equipment and it rolled over his foot. Not actually over it, his foot got caught between the two pieces. The piece released was around 2,000 pounds.
It sounds like his employer is in violation of the law. I strongly recommend he see a workers comp attorney. He should be able to get a consultation at no charge, but he needs to make sure he gets one that does a lot of workers comp and is up to date on it.
I wouldn't sign anything and then I would talk to the NC dept. that deals with worker's comp: http://www.comp.state.nc.us/ And keep pushing for answers quickly. /lost a lot of unemployment by not sticking with things and asking more questions.
So that sounds like a freak accident. And DANG! that had to hurt. My Uncle worked at a local hospital and fell off a loading dock that wasn't railed properly. He broke he arm very bad and he still doesn't have full range of motion. They covered it all and paid for him to be out of work but later his position was "out sourced". Hope you get to the bottom of the problem... which from the sounds of it, is a bad one. Good Luck!
While not everyone wants to get lawyers involved, sometimes (I think this is one of them) you need to get a workman's comp lawyer involved. I worked for a very large company years ago - got badly hurt - the company tried to mess me over and since I had excellent reviews for 5 years, I was surprised (naive) Threatening discipline is a scare tactic to keep your son from persuing his right to medical bills, and lost wages. . .don't let them do this! They are trying to cover their butts. Anyway, I got a comp lawyer, he made sure all of my medical bills and surgery was paid for, he made sure I had my workman's comp checks, and all physical therapy, medications etc taken care of. Yes, it cost me a percentage, but the company was about to leave me high and dry. I used Jernigan - (downtown Raleigh) They kept me up on everything and handled ALL communications afterward. I know I would have been up a creek if I hadn't called them - my surgery cost a mint and I was unable to work for months. Good luck to your son.
Jernigan literally wrote the book on workers comp in NC, there is none better. In all probability, he got so much more for you than you would have gotten without an attorney, his 25% didn't cost you anything. 75% of a settlement with an attorney like Jernigan is usually a lot more than 100% of what you could get on your own.
I'm in total agreement with you. They did a lot for me, financially as well as preserving my sanity - the company I worked for really put the screws to me and had me a total wreck prior to me contacting Jernigan's firm.

Workmans comp will only pay after you have been out for at least a full pay period or if you work part time it still makes you wait 80 hours. That is what I found out when I kept a man from falling at work and hurt myself. 3 other women got hurt with the same man who was large and had some dementia, confusion, and was spastic would strike out not meaning to hurt you. I had never filled out a complaint before and I just don't see it actually helpling the victom that much. First off it is confusing all the hurtles just to get it if you are hurt for a long time there is a cap to how much you can get back in wages. It takes a good while for them to start giving any lost wages so you are catching up with your bills at least that is what i found out from my experince and I didn't stay out too long of the other 3, 2 were out pretty long and both have lost their jobs now. Which I also have seen before I don't know if it is just a coincidence but it sure makes you think before complaining about getting hurt at work I just don't believe in the system anymore myself.
