DH got a speeding ticket now what?

    Mum-You don't need to feel hurt. If you do, then you should leave now and never look back. :) No one is intentionally hurtful, well most of us aren't purposely hurtful, and you can get alot of advice (some better than others). Don't get your feelings hurt. The majority of us aren't mean spirited. :mrgreen:

    Rushlow-it's 3 years of 'being good' for the PJC. :)

    Tassy-I go 5-9 miles over the speed limit too. :jester:

    No clue why they do this since I work in Radiology and not the legal system to be honest??? Just glad they did it for me to be honest! I had a momment of dumbness and was speeding in a 45 (thought it was 55 and I was still going 60)....
    I was listening to the radio and not on my normal schedule one evening and got a ticket. The DA reduced in to a 54 in a 45. I plead guilty, paid the court cost and went on.... now I try to not let that happen again!

    You are right KDS - no quota. That is a something people think is true but is not. A DA will not reduce the case "normally" if the person has multiple tickets or a bad driving record (again I said normally). That was my first ticket since 1994 and I got that ticket when I was driving home to tell my mom I had been accepted to College so that was 13 years I went with out one! LOL

    You do know that I was kidding with you. I love you dearly and have learned much from you and others. I was still trying to learn about "to" and "too" when a lot came in and I thought I would fall over. You and others have made my day today as I have laughed all day long.

    That demonstrates another reason it's good the DA has discretion to reduce the charge. You made a mistake, you paid a penalty less than the maximum the law allows, and you learned from it without having to pay the maximum penalty. Also, I agree the DA will not necessarily use that discretion to let a person off easy if they have a bad record, nor should he.

    best thing is to go early to court(court date) and ask the DA that the ticket be broke down to under 10 mph, he will be more than happy to do so for you,,

    an attorney for only 15 over? wasting your money IMO. just go and fight it, if the judge offers 9 over then take it. 9 over wont go on the insurance.

    Even if the DA agree's to reduce the ticket to 9 over, the judge will have to accept that. Most cases the judge will accept the DA's suggestion but the advantage of hiring a lawyer would be they would know the judge and have the advantage to reschedule the court appearance if needed.

    I have heard that Wake County no longer has an improper equipment provision so the ticket will not be dropped.

    Since the ticket is for 15 mph over their is a provision that he can lose his license for 30 days so my suggestion is that you pay the $250-$300 to hire a lawyer. Another thing to consider is Traffic Court could take all day. Would losing a day of work affect his pay? Figure that into the cost of hiring a lawyer.

    traffic court on my last ticket took 2 hours, and they were busy. the da offered me something ( i was well more than 15 over the limit ) and i declined and said i want to talk to the judge. the judge offered the same thing so i took it. i was going for than double his speed over the limit, no attorney, my OTD cost of court was 115$. since it was my first speeding ticket in about forever my car insurance is going to "overlook" the ticket, but if i get another ticket in the next 3 years they ( my car insurance ) will charge me for both. for 15 over you dont need an attorney IMO, but its your money, do what you want.

    Another way to look at is if the lawyer costs $250 and the court cost is $115 then the actual lawyer fee is $135. I think from that they will also pay a penalty up to a certain amount, if imposed.
