Man Demands $1.5M From Estranged Wife for Kidney

    More power to this dude. I know there are two sides to every story but this doesn't bode well for her.

    "She slapped me with divorce papers in the operating room while I was trying to save another patient's life," he told the Post.

    Here's my take on this.

    It is illegal to sell vital organs, right? So the kidney was a gift?

    You can't get compensation for a gift if you break up. That's like giving your boyfriend a TV for Christmas and he breaks up with you in February. You can take him to court, but the TV was a present, not a jointly aquired asset, so you would be SOL.

    Anyway, that's how I see it.

    So here's my take on it. If he had bought her a house or a car, it would most likely have been considered a marital asset, as opposed to just a straight-out gift. He would then have been entitled to 50% of the FMV of the asset upon the divorce. So if you consider the kidney a marital asset, then she should have to pony up (or deduct from her portion of the settlement) $750k. She should then sue him for have of the FMV of the children, as she created them from her body and shared them with him, less a nominal fee for the sperm donation ($50 or so). Since the FMV of the children is probably much higher than the kidney, although I'm not an actuary/economist/valuation analyst, he should be laughed out of the courtroom for filing suit in the first place.

    What's next? Someone donates a kidney and then sues the recipient because they drank or got in a car accident or somehow damaged the kidney? It's not like she gave him the divorce papers while she was in the recovery room the day after receiving the kidney. Get over it buddy. :nopity:

    Yeah and she don't deserve alimony because word is she committed adultry and he made efforts to patch up an otherwise oneway marriage on her part. Take care of the kids screw her.
    Haven't seen her but heard she is a hottie though.:jester:
