I was receiving Unemployment for a few weeks and found a seasonal tax job. I still have several weeks of unemployment money that I didn't get and won't get anymore since I have this job. So my question is, when this job ends, can I claim my unemployment again and get the money that is left?
Reading exactly what was written it appears that you are now gainfully employed so your unemployment case should be closed. If at some time in the future you find yourself un-employed once again then you would apply for unemployment in the future. It is not an account which has a particular dollar amount in your name which is tapped into as needed. Each case is completely separate.
IOW, her eligibility will be re-determined when the tax job ends, correct? And the earnings from this job are included in the calculation at that time.
There is a determination of which employers account will be debited for the claim, which comes into play. That is a grey area for me. I know of people who have left a job for another, not made it past the probationary period, signed up for unemployment, the longer period job was to be debited for the claim but fought it due to the employee quitting. The employer was not debited, but I do not know if the former empolyee got any claims. There is also still a limit, I believe, on the amount of unemployment you can receive in a calendar period so you have to work long enough to "reset" the clock, but the benefits will be determined on the pay period. I think you can continue previously claimed benefit until that amount is reached, but I am not sure nor would I want anyone to make such a decision based on less than accurate information.
When my DH drew unemployment several years ago he was able to make a certain amount a week. Over that amount was taken from his benefit but he still had the total dollar amount to draw from. He continued to file his claim each week and listed the amount he made. Some weeks he got an unemployment check some weeks he did not depending on how much temp work he was able to do in the week. Things certainly may have changed, but if this is not what you consider to be long term gainful employment you should continue to file each week listing the amount you earn and when the temp work ends you will receive the rest of your benefit--Hopefully you will find something full time soon and won't need it
When an individual applies for unemployment the reason for being there is a factor. If you quit a job you do not qualify for unemployment. The Employment Security Commission will go back 18 months into the individual's employment record and retrieve the name of the employer at that time. That is how the calculations will begin and then there are other factors which come into play. Once eligibility is determined and then the employment record is retrieve the employer from 18 months earlier is contacted that the individual is applying for unemployment. The employer has the option of being charged or not charged. I do know of a case in which an employer was contacted (18 months back) yet that was not the employer the individual was employed with at the time they became unemployed. That employer requested not to be charged. There is a maximum amount which an individual may collect in unemployment benefits. Congress will probably be extended that amount and time frame once Obama takes office. Once gainfully employed the individual's case should be closed. If the individual finds themself unemployed again then they go through the entire process again; determine eligibility, employer being contacted, etc., etc., etc. The second time you are found unemployed may be for a different reason than the first time and the amount of time between employment could be short or vast.
Since I am making a little bit more than what my unemployment was, I cannot claim it anymore, I do understand that. I just wasn't sure if I could continue claiming it after this seasonal job ends. I guess I will have to call them. Thanks!
Yes, an individual may earn under a certain amount and then it will begin to affect the weekly benefit. However, it sounds as if this person is working 40 hours a week and will do so through the middle of April (if I'm reading the original post correctly).
