    Is it legal to sell a gun on the internet?

    A complicated question. An interstate sale is different from intrastate sale. A licensed dealer can sell certain guns over the internet to certain individuals with proper permits. They can sell to anyone as long as they ship the gun to a licenced firearm dealer who handles the background check and paperwork. A pistol sale in NC should always require a purchase permit to be legal and above board.

    (B1) To whom may an unlicensed person transfer firearms under the GCA? [Back]


    A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.

    A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

    (B3) May an unlicensed person obtain a firearm from an out-of-State source if the person arranges to obtain the firearm through a licensed dealer in the purchaser’s own State? [Back]


    A person not licensed under the GCA and not prohibited from acquiring firearms may purchase a firearm from an out-of-State source and obtain the firearm if an arrangement is made with a licensed dealer in the purchaser's State of residence for the purchaser to obtain the firearm from the dealer.

    Yes, it would be easier to get into trouble, which is why Craiglist and eBay do not allow gun ads.

    If the gun is registered in your name, it might be a good idea to have a gun dealer do the paperwork to register it to the buyer if you do not know them too. (Or even if you do and you think they may in turn sell it to someone else)

    No it's not mine. Someone who doesn't have a computer asked me if I would put it on the internet to sell for them. Glad I checked. Thanks for the info Wayne.

    I had to unload some quickly and the pawn shop up by the pet store did right by me, also instant cash.

    There is a website call gunbroker.com or try a local gun dealer to handle the sale for you

    No problem, I know folks who have bought and sold guns to individuals without a problem, but if it is the first time there is a problem and it is you it does not matter how many times it worked.

    Speaking of guns: My 18 yr old dd told dh that she wanted to shoot a gun about 2 wks ago. So yesterday they went to a range in Holly Springs and they took the safety class and then she got to shoot - she was so excited!

    One of our old UPS drivers shot an MP-5 in competition. He had targets he could cover a full magazine grouping with a 50 cent piece from 25 yards on full auto. He was sold on the weapon for what seemed to be good reason.

    When I was stationed in Italy we had a contingent of Italian security on base and that is what they carried. As I was crosstrained as security I had to qualify with any of the assorted weapons we had on base. Qualified expert first time using the MP-5. Was a joy to shoot such a quality weapon...especially compared to the Beretta M-9 and M-16s we carried.

    I saw a guy in Four Oaks a couple of weeks ago that was set up like he was having a yard sale....... all he had was weapons. They look like machine guns. I was shocked to see him set up like that. Thought it would be against the law............
