Fence question in Clayton city limits

    I recently purchased in Clayton and contracted with a fence company to install a black vinyl chain link fence. I was told yesterday by one of the neighbors, that her neighbor said they are not allowed in the city limits. I called the town and of course that person was out yesterday.
    Our posts are already installed which is why they were wondering what type of fence I was installing.
    I have seen PLENTY of chain link fences in the city limits, including some of the opposite side of the subdivision.
    Anyone know? I have calls out to people, but I am trying not to stress for the entire weekend about it.
    The fence company said it was the most ridiculous thing he had ever heard.

    Drive through your neighborhood and see if anyone else has one. Don't stress~ :grouphug:

    Do you think your neighbor could have been mistaken and that chain link fences aren't allowed in your subdivision per the HOA rules? Both our neighborhood in Holly SPrings and the one here in cleveland have it included in the covenants that chain link fences are not allowed. I personally don't care one way or the other, especially with the black coated ones-I think they blend in and look much nicer than some of the wood fences where people try to install themselves or do it the cheap way. Anyways, hope your situation works out especially since you have the posts already installed and I'm sure cemented.

    The Town of Clayton, Johnston County nor any other municipality (that i know of) has any regulation as to the allowance of a fence.

    Your HOA, if one, might have other stipulations which would override any County or Town say so, however.

    Its your property. If you want a fence, you can put up a fence no matter what any neighbor might say...as long as there is no HOA regulation.

    Town of Clayton Unified Development Code - 155-402 Lansdcaping, Screening and Buffering - Part 2 Buffers - 8 - Permitted Structures in Buffer Area - c- fences iii "fences shall be constructed of high quality materials, such as treated wood and wrought iron. Chain-link fences shall not be permitted"

    Most fence companies that put up fences in the Town of Clayton should be aware of this.

    May have been installed prior to the adoption of current UDC. They would be grandfathered.

    I think it's a good idea for you to check with the City first before completing the job. I have experience with that situation while living in FL. We have old chain links in our backyard and we wanted to replace it with the new one. We did that and guess what? Lo and behold, the City gave us the notice that fence is no longer allowed in the city limit. Leave old one in or take it out, nothing to replace it. So with all hard works and money wasted for nothing, so I don't want that happen to YOU.

    I am not going to let this go easily. The fence company should have been aware, and told me they install them ALL THE TIME in Clayton city limits. I am anxious to have this settled. The covenant did not say NO to chain link, just nothing over 6 feet. There is no HOA. Grrrr:evil:

    Our HOA said they "prefer" chain link to be black or green but did not say anything about the regular we put up. We are out of the city limits though. I know that there is a house on O'Neill St. that has regular...I think!!

    I believe a pe mit was also required for the fence.

    So, what is the reason some towns don't like chain link fencing? Is it the appearance?

    I had FIVE different companies come out to do estimates. Not one of them mentioned a permit or anything about chain link fences not being allowed. I moved to NC last July, 4 months after the last ordinance was put into effect. How was I supposed to know? If I had not seen ANY chain link fences in my subdivision I might have questioned it, but that was not the case.

    Well the fence company said I did not need a permit, that was my first mistake.
    I found out that the ordinance was passed 2 years ago that no more chain link fences would be allowed.
    The posts were pulled. I know have my permit. I am STILL waiting to hear back from the fence company with a new proposal for a wood fence. I am out 400 dollars for something I do not have. :evil:

    Who is the fence company? If they're local there's no excuse for their ignorance. It would be different if this was strictly your subdivision's covenants but a local company should be aware of the Town of Clayton ordinances. On a side note, are there ordinances outside town limits (but within JoCo) about how far off a property line a fence must be placed? Nothing in our covenants at all about it but just wondering if there is some rule somewhere I couldn't find.

    If its the same fence co, I'd ask for the $400 credit towards the wooden fence! :evil:
