"He was hollering the n word, you black so so," said John Downey. "I kept telling him, 'You ain't got to talk that way.'" On Saturday evening, Downey said he picked up a backhoe from a home on Brown Road. He said he pulled over across the street from Fuqua's property to make a quick repair to his truck. While he was working on his truck, Downey said Fuqua approached him, started yelling racial slurs and told his wife to go get the gun. "He was upset about a backhoe that has never been on his property, never been in his driveway," he said.
