Barking dogs... and come say "Hi" to Cleo!!

    So, this is what I found under ordinances:

    Sec. 4-11. Barking dogs.
    It shall be unlawful for any dog owner to keep or have a dog that habitually or repeatedly barks in such a manner or to such extent that it disturbs the peace and repose of a reasonable person within the immediate vicinity.
    (Ord. of 5-8-2000(1), ยง 9)


    Perhaps I am lazy, perhaps my google skills are off since my three month sabbatical from the net... But here is my question, is there a time frame in which this has to occur in order to have "the law" pay a visit? Like after 10PM or something? I plan on speaking with the neighbor, of course - but if that does not curb the problem, I want to know what my rights are so that I can inform them as part of my friendly request to care for this nuisance.

    allI know is no excessive barking is allow and you can call the NON EMERGENCY number for the sheriffs office to find out the rules. That number is 989-5000. (i have the darnedest things in my phone)

    Perhaps they should not bother having four dogs if they are just going to leave them outside 24/7. Do I not have a right to peace & quiet on my own property?

    Welcome back. I missed you (really!)

    The law is stated in such a way that there is no time frame involved. It can be 2:00am or 2:00pm.

    The question(s), however, are:
    1. What constitutes disturbed peace?
    2. What's the "immediate vicinity"?

    I would suggest that you take a video recording of your cable box (which will have the correct, unalterable time) and have the windows open so the dogs barking can be picked up in the recording. That way you can prove the incessant barking and the length of time and time of day (or night).

    and boy oh boy am I glad I don't live in a S/D anymore. :mrgreen:

    I don't think there is any time frame so to speak, cleo. But I would chat with the neighbors then give them say 2 strikes maybe 3 then I would go to the next level..............

    Print out a copy of the ordinances and highlight all the laws they are breaking and put it in the mail. Then they get it the next day with their regular mail, and maybe that will work. Maybe they do not know what the laws are. I have exact same neighbors who do not give a hoot about their dogs getting out and barking and chasing and scaring all the neighbors, and trampling everyones yards......Maybe my neighbors don't know about the leash law, but I might call the authorities also when the dogs get loose again....

    It works. I seen some neighbors do that and the people got rid of their dogs because they thought it was from the Home Owners Association. Its worth a try. Just don't get in trouble for going into their mailboxes. The pizza guys are always putting something in my mailbox.

    My neighbor also has a dog that barks non stop. The dog is chained, but he is also a big dog. Eveytime my grandkids come over and we go outside the dog goes ballistic when my 2 year old grandbaby is out there. I hope to God the dog never breaks free. I have mentioned this to the neighbors but he thinks it is funny and says the dog won't get loose. He lets him loose sometimes and the dog is very docile and friendly. He just got the dog as an adult and really doesn't know anything about it. Needless to say it is not fun outside worrying about that dog all the time.

    My take on this is simple - IF the dog(s) have something to bark about and it stops within a reasonable amount of time - say 5 minutes tops, maybe they are just alerting their owner something is going on and no matter what time of day, I deal with it.

    In a situation now - next door neighbors went away for a few days and I believe the neighbor on their other side is feeding their dog - unfortunately, the dog is tied out and it barks ALL NIGHT LONG! Probably cause it's used to being inside and it's been so darn cold out! I like my neighbor and never have had a problem with them, have been told by hubby that the dog is very nice - so it leaves me in a bit of a dilemma.

    I've decided that when they get home I'm going to pay them a visit and mention that the dog sounded distressed and offer to let the dog in their house LATE at night (perhaps into a crate or confine in laundry room if they don't want to give him free roam when they aren't home) and then return him outdoors EARLY in the am....this whole week I've been getting up at 3:45AM and not getting to bed much before midnight, so exhausted and my bedroom being closest to their home has made me retreat to sleeping on the sofa in the den :x Hopefully, they won't take offense and will take me up on the offer. Since they are good neighbors otherwise, I don't want any hard feelings, but a girl needs her sleep.

    Talk to the neighbors with the annoying barkers - but do it when you are in a good mood. You can catch more flies with honey -

    The animals are right next door. They have been barking all along, but never really bothered us until the weather warmed up and we opened our windows, or tried to enjoy our screened in porch at night. They bark constantly. They bark because other dogs bark, they want inside, a cat might be out in the woods..... who knows. I don't speak bark. If I did I would tell them to shut up. Although, I doubt that would work since the neighbor opens his back door every night and screams just that at them.

    All I wanted to know is what the laws were. I plan on telling them this afternoon they need to bring their animals inside - how else would you get four dogs to shut up at night? I have no problem doing this. In the event they do not follow through, I am prepared to have the law enforced and they will be privy to my intentions.

    It's common courtesy, and it's also apparently the law.


    Anyway....

    HEY EVERYBODY!!! You too Cliff!!

    Jen, I swear that baby of yours was ready to get up and walk around the other day. I have never seen a more astute 3 MO. Amazing!!! And beautiful. :)

    Dogs do bark right? I am not sure if there is a GS that references a Barking Dog. What was that GS again?
