OK, so one of my customers has filed for chapter 7. Of course right before I filed to take him to small claims court. Should I still file? Jo Co is $91 PER CLAIM. I've broken down these per job we did and there are 5 of them. So, save my $455 or still do it. Theres a "meeting of creditors" in July that I plan on attending. I've read up on the chapter 7, but it doesn't make sense to me. Tell me the REAL deal. TIA.
You're probably gonna be in a long line of creditors, few of whom can expect to receive anything. You might gain a Pyrrhic victory. My counsel is to not spend the 91 bucks, and the waste of time and mental energy. As much as it hurts to lose the 455 bucks, I don't see how getting a judgement on which you might collect no more than 50 cents won't make you feel better. Snidely Whiplash, maybe. You? No way! I can't begin to know the reasons why the client finally filed Chapter 7, but for most, it's the last step and they have suffered for a while looking at it in the face. No one I know does it for warm and fuzzy reasons. Can you recover any of the equipment or gear and possibly reuse it? That may be the only way you gain anything. Good Luck.
No, do not file anything in any court other than the bankruptcy court. I practiced for many years as a board certified specialist in consumer bankruptcy law, call me.
I'm not sure the customers would like me coming to their house and taking out their in wall/ceiling speakers. :lol::lol: I wrote it off on 08 taxes for *bad debt*, I sure as hell would like to see $12K though :boxing::boxing:
Agreed that removal is not a good thing. I'm not an accountant. It seems to me that if you wrote this off, and collected anything for it later, you would have to adjust your return to some degree. You may want to check with your CPA. Sorry it happened to you.

Hey lady! I work for a bankruptcy atty......Don't waste your time....You'll end up spending MORE money to do it and not get anything anyway. The meeting of Creditors is an actual "court appearance" for the debtor. Creditors can go and object to it and all that but none usually do because they end up getting nothing anyway. Sorry, dear.........
