    Doesn't seem like their presence means much if they cannot even detain anyone.

    I heard a mention of it on NPR last week, but I agree it was not covered much.

    I think its just the mainstream media making too much of a story with little details. What constitutes National Guard "troops"? Three Guardsman versus two dozen drug runners?

    I do agree that it seems silly to not allow the Guard to apprehend illegals. What are they doing down there...observing? If this is a matter of national security or state security, why can't they detain them at least. The new item seems to indicate a lack of authority at the borders.

    Given when the National Guard is Federalized the restraints of Posse Comitatus are engaged and they cannot be employed in any but support functions where law enforcement is concerned.
