This might get me flamed but I think there needs to be some kind of cut off age for drivers. IMO elderly drivers are just as dangerous, due to health concerns, as very young drivers are, due to inexperience. The man is 88 years old and has had 2 wrecks in 3 months. Time for someone to take the keys away.

If they don't charge him with anything, they probably have not legal backing to take his license away.

Usually in a case like that, the law can order the DMV to road test a person they consider to be growing incapable of passing. I know it turns organizations like AARP inside out to think their rights are being trampled on, but the elderly need to be closely monitored just like teens. Public safety has to trump individual independence.
