She now has to serve her full 45 days with time served instead of 23 days. She should have stayed in jail....maybe she now learns something...hmmm
I doubt she will learn anything... But I do think it was the right choice for the judge to make. Now if someone will make her go to REAL jail (no delivered strawberries, etc.) I know...really punish her....take away her make-up and all mirrors..
They interviewed a lawyer on CNN earlier and he was saying how much of an insult to the legal system the judge was for doing what he did and that he overstepped his authority...........What a joke! I also learned that in CA a person does not have to appear in court for a misdemeaner. Their lawyer can fill in for them. Is it the same here?
Yes, a defendant can sign a waiver of appearance. That's especially convenient for out of state drivers who get speeding tickets here, because a lawyer can usually get the charge reduced to one that will not hurt so much on the insurance points. But if they were speeding more than 15 mph over the limit, then they have to appear, it cannot be waived. Edit: sorry, not for misdemeanors, but for infractions. It does not apply to anything that could result in jail time.
