    Do you all think that a person caught dealing drugs while in this country illegally should ever be given the chance to post bail? :?

    HARSH Penalties for drug dealers. AND I MEAN HARSH.

    The purpose of bail is to make sure the person will show up for trial. I would think there is a strong argument that an illegal alien would be a flight risk. I'm not sure I would want to be the bondsman who puts that up. Has he posted bond yet?

    Yeah...The key here is an "Illegal Alien". I don't think they mind running.

    If he is simply deported, aren't the odds that he will return to another small community? :? I don't think he should be able to post bail and flee the country, I think he needs to be handed over to the feds and something HARSH needs to be done about his crimes (illegal entry + drug dealing) against the US.

    The NC Constitution requires bail for all crimes except for 1st degree murder where the death penalty is sought. The 8th amendment to the US Constitution forbids excessive bail. Both would have to be amended.

    I like it when they post bail. If they can find a bondsman to take the risk, when they skip out, the school system gets the money. I'll take $101,000.00 for the county any day.

    But this really is academic. I think what some people don't know is that ICE (the new immigration folks who replaced IDS) usually put an immigration detainer on illegal aliens charged with serious crimes, meaning that posting bail is pointless because they can't get out anyway. So while the issue seems appealing on the surface, it really isn't an issue at all.

    Brilliant, it is to bad that most bail bondsmen are to smart for this, and those that aren't are quickly out of business.
