A judge is suing over a pair of pants that he thought were not done well. All because of a sign that said "satisfaction guaranteed". He is suing for millions to teach businesses not to use "satisfaction guaranteed". UNBELIEVABLE! It was on WRAL this morning but I don't have time to find it. What do you think. So I can take any business to court for my feelings, right? I do not understand these sue(sp) happy people. tell me what you think.
update WASHINGTON (June 12) - A judge had to leave the courtroom with tears running down his face Tuesday after recalling the lost pair of trousers that led to his $54 million lawsuit against a dry cleaner. Administrative law judge Roy L. Pearson had argued earlier in his opening statement that he is acting in the interest of all city residents against poor business practices. Defense attorneys called his claim "outlandish." He originally sued Custom Cleaners for about $65 million under the District of Columbia consumer protection act and almost $2 million in common law claims. He is no longer seeking damages related to the pants, instead focusing his claims on two signs in the shop that have since been removed. He alleges that Jin Chung, Soo Chung and Ki Chung, owners of the mom-and-pop business, committed fraud and misled consumers with signs that claimed "Satisfaction Guaranteed" and "Same Day Service." Pearson, representing himself, said in opening that he wanted to examine the culture that allowed "a group of defendants to engage in bad business practices for five years." An attorney for the Chungs portrayed Pearson as a bitter man with financial troubles stemming from a recent divorce who is taking out his anger on a hardworking family. "This case is very simple. It's about one sign and the plaintiff's outlandish interpretation," attorney Chris Manning said. The Chungs were to present their case Wednesday. Manning asked D.C. Superior Court Judge Judith Bartnoff to award them reimbursement for their legal costs if they win. Pearson called several witnesses Tuesday who testified that they stopped going to Custom Cleaners after problems with misplaced clothes. Pearson also called himself as a witness, saying his problems began in May 2005 when he brought in several suits for alterations. A pair of pants from a blue and maroon suit was missing when he requested it two days later. He said Soo Chung tried to give him a pair of charcoal gray pants. As Pearson explained that those weren't the pants for the suit, he choked up and left the courtroom crying after asking Bartnoff for a break. Pearson originally asked the cleaners for the full price of the suit, which was more than $1,000. But because the Chungs insisted the pants had been found, they refused to pay. Manning has said the cleaners made three settlement offers to Pearson, but the judge was not satisfied and increased his demands - including asking for money to rent a car so he could drive to another business.
So it is the same case. Thanks for the update, Wayne. I hope the judge awards the Chungs a generous amount for their legal fees and costs.
And the plaintiff gets the proper attention from his peers, as well. The professional groups are clearly against this case, as they should be.
Pearson cried over a pair of pants and had to leave the courtroom? Oh, brother! I think this guy needs the Nifong treatment.
The man is obviously suffering an emotional breakdown. I think the poor man needs to be relieved of his job, and his law license, and sent off someplace real quiet for a nice long vacation.
Sorry, didn't know it was already posted. I guess now they are focusing on the "satisfaction guaranteed" statement. It was on WRAL today.
Because the trial just started yesterday. He sued the people a while back, and the case is just now getting into court. I will be interested to see how the (real) judge in the case rules. (It's a little confusing, because they refer to the plaintiff as "a judge" - he's an administrative law judge, like the ones who decide Social Security disability cases and workers comp cases. When it was in the news before, they were saying a number of groups wanted to make sure he did not get reappointed to that position.) I can only imagine what the suit looked like . . .
I don't think he's lost his mind. I think he thinks he's very smart and can get away with this! If you're saying he's lost his mind figuratively then I agree. He's just plain ignorant to even try something like this. I feel really sorry for these people he's suing. I hope the judge throws the book at him and he ends up with nothing and has to pay their legal fees as well! What a whiney-hiney to even cry over a blue and maroon suit! I'm with KD'sGrandma...would love to see that multi-million dollar suit. I don't care if it was diamond studded...it still wouldn't be worth the millions he's asking for and it would still be UGLY!
More info on the judge, it seems he was up for re-appointment the first of this month and was not. His bio is no longer on the court web site but he may not be completely out as there were references to his being assigned to desk work as well. He also has a history of abuse of the system as indicated by his divorce: http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=va&vol=0561044&invol=1
What a loser. He even wanted his wife to support him after their divorce! I bet she's more than glad to be rid of him!
The Judge in this case said he will make his decision within the week, I wonder why it will take that long. Probably because the butthole will appeal it every way he can.
Hooray, the Chung's won. http://news.yahoo.com/s/ap/20070625...on_pants_12;_ylt=AsqTr0m0SKlLCSmoOJc_E5AE1vAI
