    They are right under the letter of the law, but not the spirit. The negative publicity will far outweigh any monetary gains, but in this economy they may be circling the drain anyway.

    Working in the Apt industry as long as I have, I have seen this exact problem before. Needless to say, I've always waved the moveout/lease break fees for a deceased person.

    But yeah, legally they could pursue the charges.
