The judge threw out the plaintiff's case based on the fact that she herself was not harmed and was merely an accidental casualty of any impropriety. It does not change the fact that some racial funny business went on there. "There are no allegations that defendant Hiers's racially offensive comments were either directed toward plaintiff or made with the intent to harass her."
The merit of the case was not the point being addressed, just the standing of the person bringing the case. There will be no other determination on those claims unless there is a case brought by someone with standing, which would be one of the people supposedly targeted. No determination of fact other than standing was made so there is nothing to be done regarding the accuser in civil court much less criminal court. There is no law preventing litigation if one shows standing, even if one does not win.
