Someone Please Help!!

    Right, when you went to the lawyers office you signed a deed, probably a quitclaim deed. He refinanced and paid off the mortgage, so you were no longer on the mortgage.

    Thank everyone for your replies. She has actually already filed for bankruptcy...Chapter 8 or something...I can't remember. He had thought about selling his part of the house to her because she won't agree to "completely" sell the house. Could he get a court order to sell the house since she has already filed bankruptcy? 900+ a month is really alot to pay when you're only making about 1200 a month...and now that he's been laid off, he's really stressing about it. And honestly, it's not that nice of a house...he wouldn't be losing anything. There are traliers our there nicer than this house..with more room nonetheless. :) I'll pass on the advice to him. Thanks again guys :)

    My husband went through this when him and his ex split. They were never married but the house was in both their names. In order to get his name off the house, she had to refinance in her name only. The only other option is to sell the house and split the profit. Good luck!

    You should definitely contact an attorney. And find out what type of bankruptcy she filed and if her bankruptcy included the mortgage. If it did, and she filed Chapter 7, she should be legally absconded from her liability for the mortgage, leaving him with the sole liability. This does not mean that she would be removed from the deed, but it does mean that if he stops making the payments they'll go after only him.
